FIREBIRD ACADEMY OF BALLET (FAB)
TERMS AND CONDITIONS

1. PAYMENT

a) Invoices for the following term are distributed via email at the end of each term.

b) Payments can be made by Online Transfer, Cash, or Cheque.

c) Any cheques returned unpaid will incur a £15.00 handling charge.

d) FAB reserves the right to refuse payment by cheque if this form of payment has been returned in the past.

e) Fees are payable on a termly basis.

f) Payments made later than 14 days after the first lesson of each term will be subject to a 5% late payment fee.

 

2. DISCOUNTS

a) A Multiple Class Discount will be applied to the invoice if your child takes three classes or more at FAB. FAB will deduct 10% from the bill and this will be shown on your invoice. The Multiple Class Discount is only applicable to students who take a full term of classes (and not to those who have joined part-way through the term.

3. CREDIT NOTES

a) Credit Notes are issued to cover circumstances such as cancelled classes or long-term absence through injury or illness. All credit notes are deducted from the following term’s bill.
b) Fees are not waived in respect of family holidays, school trips, school exams, short term sickness or injury.
c) Instances of credit notes issued for a long-term sickness or injury will be addressed on an individual basis and must be agreed to in writing by the Principal.

4. EXAMINATIONS

a) Invoices for examinations and associated costs are distributed on an ad hoc basis as necessary
b) All examination invoices must be settled within 14 days of the invoice date as entry fees will have already been paid by FAB on the behalf of the Parent/Guardian.
c) Invoices unsettled after 14 days will be re-issued with a 5% surcharge added to them.
d) All Examination Entry fees must be paid in any event before the Date of the Examination.

5. EXTRA COACHING

a) Invoices for additional coaching sessions are distributed on an ad hoc basis. All extra coaching invoices must be settled within 14 days of the invoice date.
b) Invoices unsettled after 14 days will be re-issued with a 5% surcharge added to them.

6. TERMINATION OF CLASSES

a) If a pupil wishes to discontinue a class with FAB, written notice must be received by FAB a minimum of 6 weeks prior to the commencement of the term for which the notice is being given.
b) Absence of notice or late notice for exceptional circumstances will be addressed on an individual basis.
c) In the event of a pupil leaving FAB with fees outstanding, FAB reserves the right to pursue recovery of the debt by all legal means including court action.

7. CANCELLATION OF CLASSES

a) Occasionally it is necessary to temporarily change the venue of a class or postpone it to a later date. Where this occurs FAB will try and notify the parents/guardians either by SMS, email, notice board, website, letter or phone.

b) We reserve the right to cancel any class anytime up to and including the date the class starts. Should this occur we will endeavour to give you as much notice as possible and either a replacement class will be provided or a credit note will be issued.

8. MISCELLANEOUS

a) All teachers are qualified, CRB checked and insured and are fully aware of our child protection policy. Due to the nature of teaching a performing art, it is sometimes necessary to correct positions physically. This is always conducted with the utmost care and professionalism.

b) Any changes to these Terms and Conditions will be announced on the notice board.

 

9. CONDITIONS OF ATTENDING OR USING FAB’S SERVICE

a) Ballet, as with any physical activity or sport, has inherent dangers which can result in injury or death.  It is incumbent upon the applicant to determine, along with the advice of a physician, if this is a suitable activity and risk.  Student training involves balance and coordination, and attempting movements that a student may not have done before. We start gradually, especially with younger students, but improvement comes from learning new movements that are physical in nature.

b) FAB cannot be liable for loss or damage to personal property. Please secure your belongings.

c) FAB is only responsible for students while they are in class. Students are not supervised when they are outside the classroom.

10. RESPONSIBILITIES OF THE PARENT OR GUARDIAN

a) These terms and conditions, and any enrolment or model release form you have signed, constitute an agreement between you and FAB for the purposes of classes or services, and supersede any prior agreement.

b) Class attendance is deemed to be acceptance of the current Terms and Conditions.

c) It is the responsibility of the Parent or Guardian to notify FAB of any illness or injury that may affect the child’s participation in class.

d) It is the responsibility of the Parent or Guardian to ensure that we have correct details for you and your child and to keep us updated of any changes to the student’s health or wellbeing.

e) It is the responsibility of the Parent or Guardian to regularly read the website notice board or notices sent via any other form of communication, including but not limited to email, text, or phone call, in order to be fully aware of all upcoming events.

f) In the event that we consider you to be in breach of these Terms and Conditions or that your child is disruptive to other pupils or teachers, we reserve the right to exclude your child from any activity within FAB.

g) FAB hires premises from Third Parties, therefore all staff, parents, guardians and pupils must abide by the codes of conduct as set out by those Third Parties.

h) Parents or Guardians should read and be aware of our Child Protection, Health and Safety, and GDPR Compliance policies. These are available on our website and are available as hard copy upon request.

11. CONTACT

a) In the case of a problem, please speak to the Principal as soon as possible so that we may resolve any issue as best as we can.

12. PERSONAL INFORMATION

a) Photographs, sound and video footage of pupils taken by FAB may be used for publicity purposes. This publicity may include forms of media that are known or as yet unforeseen such as the internet, printed materials, television, and visual display. Permission for use of photographs, sound and video will always be requested before use. This permission is granted to us by the parent/guardian filling out a model release form.

b) All personal information held by FAB will be put into a database. This database is used by us to hold information regarding pupil’s progress and to hold vital contact information. Contact details stored by us may also be used to let parents and guardians know about future events. In filling out the registration form for attendance at FAB, permission has been granted to FAB to hold such data.

c) Any personal information we collect will be used in accordance with the Data Protection Act 1998 and other applicable laws. These Terms and Conditions do not affect your statutory rights as a consumer. We are governed by English law. The purchaser and supplier agree that any problems fall under the jurisdiction of the English courts. All the clauses and sub clauses in our Terms and Conditions are independent of each other. If one clause or sub clause is invalid or unenforceable, this will not affect any other clause or sub clause. Descriptions and photographs included on the FAB website give a general idea of the different types of classes that we supply. They do not, however, constitute an agreement between you and FAB or its suppliers and/or subcontractors.
